These Terms of Service ("Terms") are an agreement between RUMPELSTILTSKIN AI ("we", "us", or "our") and you for your access to and use of https://rumpelstiltskinai.online (the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

RUMPELSTILTSKIN AI provides an AI-powered tool that generates short videos from photos you upload and the settings you choose.

AI Models Used

Videos are generated with third-party AI models. The Service currently uses OpenAI's GPT Image model to redraw the uploaded photo and MiniMax's video generation model to produce the video. These models are accessed through third-party API providers, and the models used may change over time.

The Service is independent. It is not affiliated with, endorsed by, or connected to the creators of any video, song, or trend that its output may resemble, and it does not provide any third-party video, sound recording, or music.

Available features, models, supported content types, limits, and technical requirements may change over time. Current functionality and applicable usage terms are shown within the Service.

We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

3. Account Registration

An account is required to use the Service. Available sign-in methods are shown within the Service.

You are responsible for maintaining the confidentiality of your account access and for all activity that occurs under your account. You agree to provide accurate information and to notify us if you believe your account has been accessed without authorization.

By creating or signing in to an account, you acknowledge these Terms and our Privacy Policy.

4. Billing and Payments

The Service sells credits in one-time credit packs. It does not offer subscriptions, and purchases do not renew. Current pricing, credit amounts, expiration periods, purchase eligibility, and other package-specific terms are provided on the Pricing page, checkout page, account billing page, or other purchase-specific terms shown at the time of purchase.

Payments are processed by third-party payment processors available at checkout. We do not store full payment card details on our own servers.

By purchasing a credit pack, you authorize the applicable payment processor to charge the selected payment method for the applicable fees.

Refunds are governed by our Refund Policy.

5. Credits

The Service uses credits for AI processing.

Credits may be temporarily held when processing begins. The held credits may be charged or released depending on the outcome, including whether an output was delivered, whether a request was canceled after processing began, and whether submitted or generated content violated these Terms or applicable policies. Successfully delivered outputs are charged. Processing failures may result in the release of held credits.

Credits are usage units for the Service and do not represent cash, stored monetary value, legal tender, or a deposit account. Credits are tied to the account that received them and may not be transferred, sold, shared, or exchanged unless we approve an exception.

Credits may expire. The applicable expiration period is shown on the pricing page, checkout page, credit pack terms, or other purchase-specific terms when credits are issued or purchased. If there is a conflict between these Terms and the expiration terms shown at checkout or on the pricing page for a specific purchase, the purchase-specific terms control. You are responsible for reviewing any expiration terms before purchasing or using credits.

Requests canceled after processing has begun may still be charged. Successfully delivered outputs are not eligible for credit restoration solely because of dissatisfaction with output quality or results that differ from your inputs or expectations.

You must not attempt to circumvent credit usage, billing systems, rate limits, or usage limits.

6. Acceptable Use

You must not use the Service to:

• violate any law or regulation;
• infringe intellectual property, privacy, publicity, or other rights;
• transmit malware, harmful code, or abusive traffic;
• reverse engineer, interfere with, or compromise the Service;
• scrape, overload, abuse, or disrupt the Service;
• circumvent billing, credits, rate limits, access controls, or usage limits;
• upload a photo of any person other than yourself without that person's permission;
• upload a photo of anyone under 18;
• create content that harasses, defames, sexualizes, or misrepresents a real person;
• generate illegal, harmful, deceptive, abusive, infringing, or rights-violating content;
• commit fraud;
• evade platform rules or enforcement systems.

Prohibited Content

You must not submit, upload, generate, edit, or distribute any of the following through the Service:

• Pornographic or NSFW content: pornography, sexually explicit material, nudity, or other content that is not safe for work.
• Violence and gore: graphic violence, gore, mutilation, or content that promotes, glorifies, or threatens violence or self-harm.
• Hate speech: content that attacks, demeans, or incites hatred or discrimination against people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or a similar characteristic.
• Child-unsafe content: child sexual abuse material (CSAM) and any content that sexualizes, exploits, or endangers anyone under 18. Photos of anyone under 18 may not be uploaded at all.
• Deepfakes and impersonation: content that depicts a real person without their permission, or that is made to impersonate a person or to mislead others about what a real person said or did.
• Copyright and trademark infringement: content that copies or uses another party's copyrighted work, trademark, logo, or other protected material without permission.

We may review content submitted to or generated by the Service, including with automated moderation. We may reject, withhold, or remove content that violates these Terms or applicable policies.

Reporting Violations

If you see content made with the Service that you believe breaks these rules, shows you without your permission, or infringes your rights, report it by email to hello@rumpelstiltskinai.online or through the contact page. Include a link to or copy of the content, where you found it, and why you believe it breaks these rules.

Where we find that reported content breaks these rules, we may remove the content, withhold related output, and suspend or terminate the account responsible.

We may suspend or terminate access if we believe your use violates these Terms or creates risk for the Service, other users, or third parties.

7. AI Output and User Responsibility

The Service uses AI processing to generate, transform, or edit digital content. AI-generated output is provided "as is" and may be inaccurate, incomplete, inconsistent, duplicated, misleading, contain defects, or otherwise be unsuitable for your intended use.

You are responsible for reviewing, editing, validating, and deciding whether to rely on or publish any output.

We do not guarantee:

• accuracy;
• completeness;
• originality;
• legal compliance;
• suitability for a particular purpose;
• exact adherence to your inputs or instructions;
• preservation of every detail or characteristic in submitted content;
• acceptance or approval by any third party.

The Service is not a substitute for professional legal, financial, medical, tax, academic, compliance, or other regulated advice.

8. User Content

As between you and us, you retain any rights you hold in the content and materials you submit to the Service.

You grant us a limited license to receive, process, transmit, and display your submitted content and generated output only as needed to provide, operate, secure, and improve the Service, enforce these Terms, and comply with applicable law.

To provide the Service, your submitted content may be processed by third-party service providers. We do not currently use your submitted content to train our own AI models. You are responsible for ensuring that you have all rights and permissions needed to submit content to the Service and to use any generated output. This includes the permission of every person shown in a photo you upload.

The Service does not add third-party songs or sound recordings to generated videos. If you add a sound or song when you post a video elsewhere, you are responsible for having the right to use it.

9. Intellectual Property

The Service, including its software, design, workflows, branding, text, graphics, documentation, and other materials, is owned by us or our licensors and is protected by intellectual property and other laws.

Except as allowed by these Terms, you may not copy, modify, resell, sublicense, distribute, reverse engineer, or exploit any part of the Service.

These Terms do not transfer ownership of the Service or our intellectual property to you.

10. Privacy

Your use of the Service is also governed by our Privacy Policy.

The Service may process personal data such as account and authentication information, payment-related information, usage information, and content you submit for processing, as described in the Privacy Policy.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws that cannot be waived by contract.

After termination, provisions that by their nature should survive will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, payment obligations, and dispute-related provisions.
